Terms of Service

1) Agreement

These Terms of Service (“Terms”) govern your access to and use of Autivia.ai (the “Service”). By creating an account, purchasing a subscription or credits, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

“Autivia”, “we”, “us”, and “our” refer to Autivia, a division of KTTP Inc.

2) Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3) The Service

Autivia provides tools that help you generate and export video (and related media) using AI models and integrated third-party services. Features may change over time. We may add, remove, or modify features, models, or limits to maintain quality, safety, or compliance.

4) Accounts & Security

  • You are responsible for maintaining the confidentiality of your login credentials and your account activity.
  • You agree to provide accurate account information and keep it updated.
  • You must promptly notify us of any unauthorized access or suspected security breach.

5) Plans, Credits, and Payments

5.1 Subscriptions

Subscription plans provide a recurring monthly (or annual, if offered) credit allowance. Subscriptions automatically renew until canceled.

5.2 Credit Packs (One-time Purchases)

Credit packs are one-time purchases that can be used with or without a subscription.

5.3 Credit Rules

  • Credits are used to access generation features and may be consumed differently depending on model, resolution, duration, and settings.
  • Credits have no cash value, are not redeemable for cash, and are non-transferable.
  • Subscription credits reset each billing period and do not roll over unless explicitly stated otherwise at checkout.
  • Credit packs remain available while your account remains in good standing, unless stated otherwise at checkout or required for fraud/security reasons.
  • We may correct credit balances if we reasonably believe there was an error, abuse, fraud, or unauthorized activity.

5.4 Billing & Taxes

Payments are processed through our payment processor(s) (e.g., Stripe). Prices may be shown in your local currency where supported. Taxes may apply based on your location and applicable law.

5.5 Price Changes

We may change pricing or plan features. If you have an active subscription, changes typically apply at renewal (unless required sooner for legal, tax, or security reasons), and we will provide notice where required.

6) Cancellation and Refund Policy

6.1 Cancel Anytime

You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will not be charged for the next period once cancellation is processed.

6.2 No Refunds (Typical for Credit-Based Digital Services)

All payments are final and non-refundable, including subscription fees and credit pack purchases, except where required by law. We do not provide prorated refunds for partial billing periods, unused credits, or unused time.

6.3 Exceptions (Limited)

We may, at our sole discretion, issue a refund or credit adjustment in limited cases such as duplicate charges, billing errors, or verified unauthorized transactions. If you believe an error occurred, contact us promptly at support@autivia.ai.

7) Acceptable Use

You agree not to use the Service to create, upload, distribute, or promote content that is illegal, harmful, or infringes the rights of others. This includes (without limitation) content that:

  • violates any law or regulation;
  • infringes intellectual property, privacy, publicity, or other rights;
  • contains malware, exploits, or attempts to disrupt the Service;
  • is deceptive, fraudulent, or used for impersonation or scams;
  • depicts or promotes sexual content involving minors, or any illegal sexual content;
  • encourages violence, self-harm, or other dangerous activities.

We may remove content, restrict access, or suspend/terminate accounts we believe violate these Terms or create risk for users, partners, or the public.

8) Your Content and Outputs

8.1 Your Inputs

You retain rights to content you upload or submit (“Inputs”). You grant us a limited license to process your Inputs to provide and improve the Service, including passing data to integrated AI model providers strictly as needed to perform generation requests.

8.2 Generated Outputs

Subject to these Terms and applicable law, you may use generated results (“Outputs”) for lawful purposes. You are responsible for ensuring Outputs comply with laws, platform rules, and third-party rights (including music, trademarks, likeness rights, and copyrights).

8.3 Similarity Disclaimer

AI-generated content can be similar to content created for other users. We do not guarantee Outputs are unique or non-infringing.

9) Third-Party Services

The Service may integrate third-party tools and AI models. Third-party services may have their own terms and policies. We are not responsible for third-party services, and your use of them may be subject to separate agreements.

10) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not guarantee uninterrupted availability, error-free operation, or that any model will produce a specific result. Generation quality can vary based on prompt, model behavior, and third-party systems.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTIVIA AND KTTP INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $100.

12) Suspension and Termination

We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, created risk, or engaged in fraud or abuse. You may stop using the Service at any time. If your account is terminated, access to the Service may be removed.

13) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest version. Material changes will be posted on this page and/or communicated to you where required. Continued use of the Service after changes become effective means you accept the updated Terms.

14) Governing Law and Venue

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules. You agree that any dispute will be brought in the courts located in Ontario, Canada, and you submit to their jurisdiction.
